Name the Train Contest Official Rules
NO PURCHASE OR PAYMENT NECESSARY TO ENTER OR TO WIN. VOID WHERE PROHIBITED BY LAW.
1) SPONSOR: The Name the Train Contest (the “Contest”) is sponsored by the
City of Atlanta – Hartsfield-Jackson Atlanta International Airport (“Sponsor”) whose
decisions regarding winner selection and all other aspects of the Contest shall
be final and binding in all respects.
2) CONTEST PERIOD: The Contest will begin at 12:00 a.m. April 1, 2010 and
will conclude at 11:59 p.m. April 28, 2010.
3) HOW TO ENTER: This is an online contest only. To enter the contest, leave
a comment with your proposed name for the Hartsfield-Jackson Atlanta International
Airport train on the train video’s YouTube page – www.youtube.com/atlantahartsfield or on the airport’s Facebook
page – www.facebook.com/hartsfieldjackson.
You must be a registered user of YouTube or Facebook to be eligible.
4) PROPOSED NAME GUIDELINES: The proposed name must be original and the entry
may not contain material that violates or infringes any third party’s rights, including
but not limited to privacy, publicity, or intellectual property. The entry must
not contain or be confusingly similar to any third party’s product names, brand
names, or trademarks. The entry must not contain material that is inappropriate,
indecent, obscene, hateful, tortuous, defamatory, or libelous. The entry must not
contain material that promotes bigotry, racism, hatred, or harm against any group
or individual or promotes discrimination based on race, sex, religion, nationality,
disability, sexual orientation, or age. The entry must not contain material that
is unlawful, in violation of the laws or regulations in any state where the entry
is created. There is no limit on the number of unique proposed names that you may
enter. Sponsor is not responsible for late, lost, misdirected, or invalid entries.
Entries will be deemed to have been submitted by the person registered to the account
from which entries are received. Once you submit your entry, you will be officially
entered into the Contest. Entries cannot be revised or altered once submitted. Once
submitted, all submitted components become the property of the Sponsor. Automated
means of entry and entries by any means which subvert the entry process are prohibited
and all such entries will be void.
5) PRIZES: Grand prize for the winning entry is a $100 American Express gift
card and a certificate of recognition. The total value of the prize is $100.00.
6) ODDS: The odds of winning the prize depend on the number of entries to
the Contest.
7) WINNER NOTIFICATION AND ACCEPTANCE: There will be one (1) winner. The
winner will be notified via email. The winner will be required to reply to the email
within seven (7) days to accept the prize. If the winner is unwilling or unable
to accept the prize, the prize will be forfeited. In the event that multiple entries
are received with the same proposed name, the winner will be the first person who
submitted the proposed name based on the timestamp of the comment on YouTube or
Facebook. Any modifications or derivations of the selected name will not be eligible
to win a prize. The winning entry will be chosen by Sponsor as the most appropriate
name for the Hartsfield-Jackson Atlanta International Airport’s train in Sponsor’s
sole discretion. The selected name must be legally cleared through a comprehensive
trademark clearance process. If the selected name cannot be legally cleared through
this clearance process, an alternate winner will be selected.
Each Winner is solely responsible for the reporting and payment of any taxes on
the prize. Each winner may waive his or her right to receive the prize. Prizes are
non-assignable and non-transferable. All costs and expenses not specified are the
sole responsibility of the winner. If the winner is a minor, the prize will be awarded
to the parent or legal guardian. The Sponsor is not responsible for lost, late,
stolen, misdirected, delayed, or damaged prizes.
8) PARTICIPATION: Participation in the Contest constitutes an agreement by
each contestant to comply with these Official Rules. Sponsor reserves the right
to cancel or modify the Contest if it determines, in its sole discretion, that fraud
or technical failures have destroyed the integrity of the Contest.
9) ASSIGNMENT OF RIGHTS TO NAME: You agree that, by entering the Contest,
you irrevocably assign and transfer to Sponsor all right, title, and interest in
the name throughout the world, including, without limitation, all trademark and
copyright rights, and you agree to execute any additional documents Sponsor may
deem necessary to evidence or effectuate such assignment. Sponsor’s rights with
respect to the name include, but are not limited to: (a) the exclusive right to
use, publish, display or reproduce the proposed name throughout the world; (b) the
exclusive right to alter, revise or change the name in any way; (c) the exclusive
right to secure trademark and copyright registrations and other rights in the name
anywhere throughout the world; (d) the exclusive right to license, exploit, sell,
assign, or otherwise dispose of the name or any of the foregoing rights for any
purpose; and (e) any and all subsidiary and derivative work rights in the name.
10) LIMITATIONS OF LIABILITY: By entering the Contest, you agree that: (1)
any and all disputes, claims, and causes of action arising out of or connected with
the Contest, or any prizes awarded, shall be resolved individually, without resort
to any form of class action; and (2) under no circumstances will any contestant
be permitted to obtain any award for, and you hereby waive all rights to claim punitive,
incidental, or consequential damages or any other damages (whether direct or indirect).
Each participant further agrees to indemnify and hold harmless Sponsor and its affiliated
entities from any and all liability resulting or arising from the Contest and to
release all rights to bring any claim, action, or proceeding against Sponsor or
its affiliated entities, and hereby acknowledge that Sponsor and its affiliated
entities have neither made nor are in any manner responsible or liable for any warranty,
representation or guarantee, express or implied, in fact or in law, relative to
a prize, including express warranties provided exclusively by a prize supplier that
may be sent along with a prize. Sponsor and its affiliated entities shall in no
event be liable for any injury, damage, loss, expense, accident, delay, inconvenience,
or irregularity that may be caused or contributed to by any other cause, condition,
or event whatsoever beyond the control of Sponsor or its parents, subsidiaries and
affiliated companies.
11) LATE, LOST, & MISDIRECTED ENTRIES: Sponsor is not responsible for: (i)
lost, late, misdirected, damaged, garbled, or illegible entries; (ii) error, omission,
interruption, deletion, defect, delay in operations or transmission, theft or destruction
or unauthorized access to or alterations of entry materials, or for technical, network,
telephone equipment, electronic, computer, hardware or software malfunctions of
any kind, or inaccurate transmission of or failure to receive entry information
by Sponsor on account of technical problems or traffic congestion on the Internet
or at any web site or any combination thereof; or (iii) any injury or damage to
entrant's or any other person's computer related to or resulting from participating
in the Contest. Sponsor reserves the right to permanently disqualify from this Contest
any person it believes has violated these Official Rules. Sponsor reserves the right
to terminate, cancel, suspend or modify the Contest if any fraud, virus or other
problem corrupts the administration, security, or proper play of the Contest, as
determined by Sponsor its sole discretion.
12) GENERAL RELEASE: By entering the Contest, contestants release Sponsor,
and its directors, officers, employees, representatives and agents from any liability
whatsoever for any claims, costs, injuries, losses, or damages of any kind arising
out of or in connection with the Contest or with the acceptance, possession, or
use of any prize (including, without limitation, claims, costs, injuries, losses
and damages related to personal injuries, death, damage to, loss or destruction
of property, rights of publicity or privacy, defamation, or portrayal in a false
light).
13) PROMOTIONAL RELEASE: By playing the game, each contestant grants to Sponsor
and its affiliates, the absolute right and permission to use his or her name, address,
photograph, and likeness in any and all advertising and promotional materials, in
any manner or media whatsoever, for purposes of advertising, trade, or promotion.
Each contestant acknowledges and agrees that he or she shall have no right of approval,
no claim to any compensation, and no claim arising out of the use, alteration, or
distortion of his or her name, submission, address, photograph or likeness.

or send a self-addressed stamped envelope to the Sponsor’s address.
15) CONSTRUCTION: These Official Rules contain the entire agreement between
the Sponsor and you. All issues and questions concerning the construction, validity,
interpretation and enforceability of these Official Rules, or the rights and obligations
of any contestant and Sponsor in connection with the Contest, shall be governed
by, and construed in accordance with the laws of the State of Georgia, without giving
effect to any choice of law or conflict of law rules or provisions (whether of the
State of Georgia, or any other jurisdiction) that would cause the application of
the laws of any jurisdiction other than the State of Georgia. The invalidity or
unenforceability of any provision of these rules shall not affect the validity or
enforceability of any other provision. In the event that any provision is determined
to be invalid or otherwise unenforceable or illegal, these rules shall otherwise
remain in effect and be construed in accordance with their terms as if the invalid
or illegal provision were not contained herein.
